Digital Account Planning for UVA Retirees

UVA retirees who use their UVA email address for personal online accounts should consider transitioning those accounts to a personal email address as part of their retirement and estate planning. UVA accounts are disabled after the University is notified of a member's death, which may make it difficult for family members or executors to access personal services linked to your UVA email account. Retirees can provide family with instructions or access to their personal email account to maintain access to non-UVA personal websites and services.

Banks, financial institutions, and many brick-and-mortar businesses have processes in place to receive a death certificate along with the court order showing the holder as an executor or personal representative, access to the decedent’s accounts. It is simpler if the surviving partner or family member has access to a personal account until that work can be done.

Regarding UVA accounts, similar documentation would be required before gaining access to a decedent’s account contents. University policy prohibits giving direct access to an account to anyone but the account holder. With proper documentation and approval from University Counsel, the surviving family member can request an export of account contents. This is how it works:

  • After ITS receives the notice of death from the Provost or HR, ITS disables the accounts as quickly as possible, which can happen as quickly as the same day. In extenuating circumstances, a request can be made via UVA Records & Information Management (RIM) to request a copy of data of a decedent according to University Policy and Accessing Electronically Stored Information procedures.
  • To receive a copy of the account data, the surviving family member must provide RIM with a death certificate and a will which includes a digital asset clause. If the will does not include a digital asset clause, the family member must provide a certified copy of the letter of appointment of the representative, a small-estate affidavit, or a court order to receive digital assets. The following policy and procedures describe the process:

Accessing Electronically Stored Information of a Deceased Person:  The University will not grant access to personal data from a deceased user’s electronically stored information in the custody of the University without the prior written consent of the deceased individual or as required by law or legal requests [e.g., Uniform Fiduciary Access to Digital Assets Act (UFADA)]. University Records within that electronically stored information may be accessed in accordance with the Electronically Stored Information Release Procedures."

    • The Electronically Stored Information Release Procedures noted state:

Requests for ESI of a Deceased Person Requests for access to a deceased user's (read UVA Information Security's definition of "user") electronically stored information that is in the custody of the University requires the prior written consent of the deceased individual concerned or be allowed or required by law or legal requests (e.g. Freedom of Information Act (FOIA), Uniform Fiduciary Access to Digital Assets Act (UFADA)). Such requests should be sent to either the University's Vice-President and Chief Student Affairs Officer (or designee) or the University RIM office by submitting their Request for Electronically Stored Information (ESI) in ServiceNow. 

Such requests will be reviewed in consultation with the University Counsel’s office, for compliance with applicable laws, such as the Uniform Fiduciary Access to Digital Assets Act (UFADA). Approvals for business continuity-related requests for this type of ESI requires official University review and approval by the President or the relevant vice president (or delegate) responsible for the affected user's department or area. Such requests should be initiated in the same manner as detailed for Business Continuity-Related ESI Requests.”

  • It is important to note that the window of time to obtain approvals and University Counsel review is brief. Data deletion processes vary between vendors (ie: Microsoft/M365, Box, etc.) and are subject to change by the service providing vendor without notice. When the Microsoft 365 Email account is disabled, it remains in the delete queue up to 30 days before it is purged. If emergency access is needed to the data before it is deleted, the request process above would need to be completed, including receipt of all required approvals and reviews, before access to the account contents could be granted. Gathering the needed documentation by the executor or personal representative (death certificate, court order, etc.) does take time, so planning ahead is important in these cases.
  • For cases where the @virginia.edu address is used as a Multi-Factor Authentication (MFA) option for a personal online service, the same request for ESI should be submitted.
    • Appropriate approvals are still required (including Retiree’s department and UVA Counsel).
    • Access to MFA messages will not be via direct access to the mailbox but will be a forward from the @virginia.edu mailbox to representative’s personal email address.
    • A time limit will be established at the time of the request approval. Typical time limits are 30-60 days but will not exceed 60 days.
